THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER THESE TERMS OF SERVICE NOR ANY DOCUMENTATION FURNISHED UNDER IT IS INTENDED TO EXPRESS OR IMPLY ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

INCYBER ADVERTISING INCORPORATION, AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES OR LEGAL OR EQUITABLE THEORIES WHATSOEVER, FOR ANY LOSS OF BUSINESS, PROFITS, OR GOODWILL, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, EVEN IF INCYBER ADVERTISING INCORPORATION IS AWARE OF THE RISK OF SUCH DAMAGES, THAT RESULT IN ANY WAY FROM APPLICANT'S USE OF OR INABILITY TO USE THIS SERVICE.

INCYBER ADVERTISING INCORPORATION LIABILITY TO APPLICANT SHALL NOT, FOR ANY REASON, EXCEED THE AMOUNT ACTUALLY PAID BY APPLICANT TO INCYBER ADVERTISING INCORPORATION UNDER THIS AGREEMENT.

FORCE MAJEURE

Incyber Advertising Incorporation is not liable for any delay or failure in performance under the Terms of service resulting directly or indirectly from acts of God, terrorism, or other causes beyond its reasonable control.

NOTICES

Any notices or communications under the Agreement shall be by electronic mail or in writing and shall be deemed delivered upon receipt to the party to whom such communication is directed, at the addresses specified below. If to Incyber Advertising Incorporation, such notices shall be addressed to notice@promotioninsearchengines.com or to Incyber Advertising Incorporation, R-134, Greater Kailash-I, New Delhi 110048. If to Applicant, such notices shall be addressed to the electronic or mailing address specified in Applicant's Service registration form, or such other address as either party may give the other by notice as provided at the time of availing the services. It is the Applicant's responsibility to provide an accurate address and to ensure that Incyber Advertising Incorporation is notified of any changes to Applicant's address as specified in this Section.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties with respect to the Service and supersedes all previous or contemporaneous proposals, both oral and written, representations, writings, and all other communications between the parties with respect to such subject matter, excluding the Incyber Advertising Incorporation Terms of Service and the Incyber Advertising Incorporation Acceptable Policy.

GENERAL

The Terms of Service and the relationship between Applicant and Incyber Advertising Incorporation are governed by the laws of Delhi, INDIA, without regard to that state's conflict of laws rules. Applicant and Incyber Advertising Incorporation hereby submit to the personal and exclusive jurisdiction of the Superior Court in Delhi for the resolution of disputes arising from or in connection with these Terms of Service. Incyber Advertising Incorporation failure to exercise or to enforce any right or provision of the Terms of Service will not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties never-the-less agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision and in the Terms of Service, without statutory presumptions against the drafter, and they agree that all other provisions of the Terms of Service will remain in full force and effect. The parties expressly agree that the any Convention for the International Sale of Goods does not apply to these Terms of Service. Applicant agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Terms of Service or to the Agreement must be filed in the Superior Court in Delhi within three (3) calendar month after such claim or cause of action arose or be forever barred.

As we give you analysis,optimization and submission reports we believe to have concluded our part of the job and thus we have to wait for the search engines to spider your website. As this is done normally on monthly basis by search engines so it will surely require a very very patient wait and watch attitude from our customers. We believe to have worked 100% for you and thus only hope that search engines will list you on better ranks BUT we cannot guarantee any priority listing and our services will be limited to only these analytical reports given to you in consideration of our charges of Rs.1500.
Now this doesnot mean we will cheat you as we will surely give you submission report of your website to various search engines and it is not that you have paid us for nothing as we always wish that our clients should get better listings and nothing can stop us for working for clients satisfaction but than there are few things in life which cannot be guaranteed but one can work hard to achieve the best of results with all the honest hardwork and labour.
Please bear in mind that we are into business since 1998 and service 5000 + clients and that is why we will always have safety of our goodwill and reputation in mind. We therefore request that only those people should use our service who understand these things and the charges which you pay are only for these reports and it is like submission comes for free with NO GUARANTEE for listings.

Further if you get a priority listing on any search engines we cannot guarantee that the same ranking will be given to you always as there are other people who also work hard to submit their websites BUT as per our personal experience once a rank is attained the same is available for atleast one month to many number of months depending upon the changes made in the algorithms of various search engines.
